The Utah-based association of Realtors no longer practices NAR's Clear Partnership – HousingWire

The real estate industry is over Clear Cooperation Policy decided to go beyond just one local Realtor association and just one opinion.

In an Oct. 3 email to members in Utah Park City Board of Realtors (PCBR) has announced that it will no longer apply the explicit cooperation rule as first reported .

The Utah MLS had 1,789 subscribers at the end of 2023.

CEO Jamie Johnson said in an email to members that MLS and the PCBR board wrote a letter to NAR in August notifying the national trade group of its decision.

NAR's was established in 2020. By policy, listing brokers must submit listings to their local MLS within one business day of a home's public sale.

“We have informed NAR that we will not comply with the policy requirements until their Policy Committee meets and decides on potential changes to the policy,” Johnson said in an email to members. “However, due to NAR's Core Standard requirements, we have told them that we will wait until their policy committee has a discussion before making any official announcements regarding general membership. We do not currently enforce this policy, but to be honest, we have not received any payment for agents who have violated this policy in the past.”

According to Johnson's email, historically if a member contacted PCBR about a possible violation, the association would ask the agent to obtain a listing in the MLS — which Johnson said was always accomplished.

“Our normal MLS policy still requires an agent with a listing agreement to place a listing on the MLS unless the seller has a signed right to retain the form,” he said.

Along with the pushback from industry leaders, NAR's Clear Collaboration Policy is also under scrutiny. and located in the center.

NAR did not respond to HousingWire's request for comment, and PCBR declined to comment.
